Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the en.softcomputers.org website (the “Service”) operated by LLP “SoftComputers” (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1) Scope
1.1 These General Terms & Conditions shall apply to all contracts of LLP “SoftComputers” (Business Identification Number / BIN: 250840022086) and a contracting partner (hereinafter “Customer”) on the sale, delivery and temporary provision of digital contents, digital goods and non-digital goods (hereinafter collectively also “Goods”).
1.2 These terms shall also apply to future contractual relationships between the Customer and the Seller where the Customer is an entrepreneur.
1.3 Digital contents in the sense hereof shall be all digital services, except for digital Goods, any digitally existing access codes, product keys or other digitally existing information.
1.4 Digital Goods in the sense hereof shall be any software not existing on a physical data carrier that is provided by the Seller for downloading.
1.5 By sending the purchase order, the Customer agrees to these General Terms & Conditions.
2) Contract Conclusion
2.1 The contract conclusion for a purchase via the Seller’s Online Shop shall materialise when the Seller accepts the Customer’s offer.
2.2 The Seller may accept the Customer’s offer within five days by:
a) delivering the ordered Goods to the Customer (including digital delivery via email or download link); or
b) requesting payment from the Customer.
2.3 The contract is concluded in the English language.
2.4 The Customer must ensure that the e-mail address provided for order processing is correct and that e-mails sent by the Seller are not blocked by spam filters.
3) Subject of the Contract
3.1 The Seller shall provide the Customer with Goods (software licenses, digital keys, or physical goods where applicable).
3.2 For the delivery of software (Software Purchase), the Seller owes the permanent transfer of the software specified in the license certificate (product key/download link).
3.3 For digital content, the Seller owes the provision of the digital content. The use of the digital content is subject to the condition precedent of full payment of the purchase price.
4) Rights of Use
4.1 Upon full payment of the purchase price, the Customer obtains a non-exclusive, permanent right to use the Goods to the extent granted in the contract.
4.2 The Customer is entitled to install and use the software in accordance with the license terms.
4.3 Copyright notices, serial numbers, and other features serving program identification must not be removed or altered.
5) Customer’s Obligations
5.1 The Customer is obligated to take appropriate measures to secure the Goods (especially digital keys) against access by unauthorised third parties.
5.2 The Customer must provide the Seller with correct information required for the proper implementation of the contract.
6) Prices and Payment Terms
6.1 Unless otherwise provided, prices are total prices. Statutory VAT will be applied where required by the laws of the Republic of Kazakhstan or the destination country.
6.2 For international transactions, the Customer bears any additional costs such as transfer fees, exchange rate fees, or customs duties.
6.3 The following payment methods are generally accepted (subject to availability at checkout):

- Bank Transfer to our account at Bank CenterCredit (BCC).
6.4 If payment by bank transfer is agreed, the payment is due immediately after contract conclusion.

7) Delivery & Shipping Terms
7.1 Digital contents (Product Keys, Download Links) shall be provided to the Customer by e-mail to the address indicated by the Customer.
7.2 Delivery of digital goods is generally free of shipping costs.
8) Retention of Title
8.1 Title to delivered Goods shall remain with the Seller until the purchase price has been paid in full.
9) Warranty and Liability
9.1 The statutory warranty rights under the legislation of the Republic of Kazakhstan shall apply.
9.2 The Seller shall not be liable for damages resulting from improper use, system modifications, or software incompatibility on the Customer’s side.
9.3 Liability for data loss is excluded unless caused by the Seller’s gross negligence. The Customer is responsible for regular data backups.
9.4 In the event of a defect, the Seller reserves the right to attempt rectification or provide a replacement before a refund is issued.
10) Refund Policy (“Money-Back Guarantee”)
10.1 Specific refund terms are governed by our Return Policy accessible on the website.
10.2 Generally, valid claims for refunds on defective digital goods are processed within 14 days after verification of the defect.
11) Affiliate Program
11.1 Participation in the Affiliate Program is governed by the specific Affiliate Agreement available on our portal.
11.2 We reserve the right to terminate Affiliate accounts for violation of terms or fraudulent activity.
12) Governing Law & Jurisdiction
12.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan.
12.2 The place of exclusive jurisdiction for any disputes arising from this contract is Ust-Kamenogorsk, Kazakhstan.
12.3 The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded unless explicitly agreed otherwise.
